These Terms & Conditions govern your use of all programs and services offered by FUME Shredding Hub Private Limited (“FUME”, “Company”, “we”, or “us”), including but not limited to fitness, nutrition, personalized health coaching, genetic/gut testing, and certification programs.

By enrolling in or using any of our services, you agree to the following terms in full.

1. Medical Disclaimer & Personal Responsibility

FUME provides lifestyle, nutrition, and wellness guidance based on client-reported data and third-party diagnostic inputs. Any interpretation of health reports is for educational and lifestyle optimization purposes only and does not constitute medical diagnosis, advice, or prescription. Clients are advised to consult qualified healthcare professionals for medical concerns.

2. Scope of Services

• FUME offers online programs, including personalized health coaching, fitness and nutrition plans, expert video/audio guidance, and diagnostic services (via third-party labs).
• Our primary mode of communication is WhatsApp, email, or private coaching groups. Premium programs may include scheduled 1:1 calls.
• Information provided is based on expert experience and testing reports but may not be medically verified or 100% accurate.
• FUME acts solely as a facilitator for third-party diagnostic services. All testing, sample collection, report accuracy, timelines, and logistics are the responsibility of the respective partner laboratory.

3. Coaching & Program Participation

• You are responsible for your actions, decisions, and results.
• Any transformations, testimonials, or results shared by FUME represent individual outcomes and are not typical. Results vary based on individual health conditions, adherence, consistency, and multiple biological factors beyond FUME’s control.
• Coaching is not a replacement for therapy or medical treatment. If mental or physical health issues exist, consult a licensed professional.

4. Refunds, Cancellations & Program Policy

All programs, services, and memberships offered by FUME are strictly non-refundable and non-transferable, including but not limited to:

• VIP 1:1 Coaching (Diamond, Platinum, Gold, Fast Track, etc.)

• Health Coach Certification (Starter, Advanced)

• Genetic or Gut Testing Packages

By enrolling, you explicitly waive your right to dispute or chargeback the payment once services have been initiated or resources have been allocated.

In exceptional circumstances, FUME reserves sole discretion to evaluate resolution options, which may include service credits instead of monetary refunds.

5. Token / Part Payment Refund Policy

In case of token or partial payments made towards any FUME program, a 7-day conditional refund window is applicable from the date of payment. The refund request must be submitted in writing to 📩 contact@fume.fit within 7 calendar days.

Refunds will only be considered if the client has not initiated or consumed any core service, including but not limited to:

• Attending coaching calls

• Receiving personalized plans

• Accessing program materials

• Initiating diagnostic/testing processes

Once onboarding has started or any services/resources have been allocated, the payment becomes non-refundable immediately, even if within the 7-day window.

After 7 days from the date of payment, no refunds will be entertained under any circumstances.

Approved refunds, if any, may be processed after deducting applicable administrative, processing, and service charges.

This 7-day refund policy applies only to initial token or partial payments and does not apply to full program enrollments.

6. Payment Plan Clause

• In case of payment plans or split payments, the client is legally obligated to complete all scheduled payments irrespective of program usage, participation, or results.
• Failure to complete payment may result in suspension of services and may lead to recovery actions as per applicable laws.

7. Liability Waiver

To the fullest extent permitted by law, FUME shall not be liable for any direct, indirect, incidental, or consequential damages arising from participation in any program or use of any services.

8. Data & Privacy Policy

• We collect personal and health information to deliver coaching services. Your data is stored securely and not shared without consent.
• You agree to receive coaching updates via WhatsApp, email, and/or community groups.
• By submitting photos, testimonials, or videos, you grant FUME the right to use them in marketing unless explicitly denied in writing.
• Clients may withdraw consent for marketing usage at any time by written request; however, previously published materials may continue to be used.

9. Access & Usage of Content

• All program content (videos, PDFs, plans) is licensed for individual use only. Sharing, reproducing, or reselling any content is strictly prohibited.
• Certification programs grant non-exclusive usage rights for coaching, not reselling FUME content or methods.

10. Intellectual Property

All frameworks, systems, methodologies, program structures, and materials including the FUME Bio-Intelligence System™ are proprietary intellectual property of FUME and may not be copied, reproduced, distributed, or taught without prior written permission.

11. International Clients

For international clients, all services are deemed to be delivered from India, and jurisdiction shall remain Bangalore, Karnataka.

12. Progress, Accountability & Accuracy

• You are expected to submit regular updates (logs, photos, biometrics). FUME is not responsible for poor results due to incomplete tracking or non-compliance.
• Your plan is built on the details you provide — you are responsible for their accuracy.

13. Legal Framework

• These Terms are governed by the laws of India, with exclusive jurisdiction in Bangalore, Karnataka.
• Terms may be updated anytime. Continued use implies acceptance of changes.
• Minors must submit a No Objection Certificate (NOC) from a parent or guardian before joining.
